Islamabad High Court (IHC) has suspended Election Commission of Pakistan (ECP) decision for disqualifying Umar Amin Gandapur.
ECP had disqualified Umar Amin Gandap;ur brother of federal minister Ali Amin Gandapur for contesting election on the seat of city mayor Dera Ismail Khan (D.I Khan).
Umar Amin challenged ECP decision in IHC.
Umar Amin filed a miscellaneous application seeking suspension of the decision whereby he prayed the court to fix his petition for immediate hearing. He has prayed the court too to nullify the decision.
Election commission, chief election commissioner, regional election commissioner and senator Kamran Murtaza have been made respondents in the petition.
The petitioner said in the petition that ECP failed in meeting the norms of transparency. As per law the benefit of doubt should be given to the candidate. No one can be declared to be guilty of violation of election code of conduct without summary inquiry.
The counsel for Umar Amin Gandapur said during the hearing of the petition no notice was issued and all the proceedings was initiated against Ali Amin Gandapur. Then order was passed against Umar Amin Gandapur.
The counsel for Umar Amin Gandapur said penalty can be imposed upto Rs 50000 after summary inquiry. If the violation is committed for the second time then action can be initiated.
The court while hearing the arguments of lawyers suspended the ECP order for disqualifying Umar Amin Gandapur.
