The Supreme Court (SC) while directing to ensure implementation of court’s order in letter and spirit in the matter of construction of Bhong Interchange has wrapped up the matter.
A two members bench of SC presided over by justice Ijaz ul Ahsan took up the case for hearing Tuesday.
The court expressed annoyance over the process of changing the location of Bhong Interchange instead of implementing court’s orders during the hearing of the case and inquired from Chief Transport and Communication Sohail Fazil the court should be told at whose behest he declared the construction of Bhong interchange in accordance with court’s orders impracticable.
Additional Attorney General (AAG) Rashdin Kasuri told the court that as per planning and development report Bhong interchange is not practicable economically.
Justice Ijaz ul Ahsan remarked DDWP accorded approval to Bhong Interchange. The minutes of meeting of DDWP are attached with the report. Tell us the draft of report was changed at whose behest. Who asked to change the report. You yourself changed the report or the secretary asked to do so. We will take action against the person who changed the report.
Chief Transport and communication Sohail Fazil told the court it is not as such what court is considering. Neither court has been misled on his part.
Justice Ijaz ul Ahsan reprimanded chief transport. He expressed annoyance saying don’t try to become clever and smart before the court. There will be dire consequences of misleading the court. The sequence of report was changed at the end.
The court observed interval by directing secretary planning to appear in person.
Federal minister for planning Ahsan Iqbal along with secretary planning appeared in the court when the court resumed after interval.
He took the plea before the court the officers are worried since the last four years. I have appeared before the court to take the responsibility on me . The development budget has come down from 1000 billon to Rs 550 billion. Several projects had to be stopped due to curtailment in development budget. Non compliance of court’s orders has never been our objective. We will present our stance before the court after filing review petition. We want money is spent there where its best use is made. I have been acquitted from NAB reference recently. Case was registered against 25 employees of my ministry. We will construct interchange where the court orders. There are financial problems due to the flood. We want to file the report on funds situation in the court.
Justice Ijaz ul Ahsan remarked the matter is implementation of court’s orders. The review petition is filed if change is needed to be made The court had ordered to construct Bhong interchange with the willingness of the government. There will be weight and logic in the talk of federal minister. But the matter relates to court’s order.
Justice Mazahir Naqvi remarked may be appeal comes before us on NAB reference. It will be appropriate not to discuss NAB reference matter before the court.
Justice Ijaz ul Ahsan remarked the court has issued order and it has to be implemented. Tell the officers if SC seeks report then there should be no tempering. Government officers are employees of the state and of any government. We are giving warning to secretary planning on tempering in the report. It is expected court’s orders will be implemented.
Additional Attorney general took the plea we want to file review petition against the court’s orders.
Justice Ijaz ul Ahsan remarked the review petition can be filed within one month of court’s orders.
The court while summoning implementation report in respect of Bhong Interchange within three days wrapped up the matter.
