Mayor Mardan, Himayatullah Mayar wrote a letter to the chief minister Khyber-Pakhtunkhwa, Mayor stated in that letter that members of LCA Khyber Pakhtunkhwa extend warm congratulations on his election as Chief Minister of Khyber Pakhtunkhwa. All tiers of Local Governments in Khyber-Pakhtunkhwa are facing challenges and issues pertaining to their powers, functions and funds.
He stated that they submit before your good self the issues and request for an early meeting of the action council in presence of Ministers and Secretaries of Local Governments, Law, finance and P&D under your chairmanship. He stated in the letter that the main issues are restoration of Local Government Act 2019 with drafted rules of business 2021 (Rules of business must be consistent with LGA 2019.
The Secretaries Local Governments and Law Khyber Pakhtunkhwa release funds to Tehsil / city / metropolitan local governments and Village and neighborhood councils .Himayatullah Mayar stated in the letter that the Tehsil local governments and TMAs and VC/NC are dysfunctional due to non-availability of funds. Hence delivery of social and municipal services is at halt. He pointed out that the Tehsil local governments and VC/NC Councils in NMDs( newly merged districts) are deprived of offices, human and logistical resources which may be taken on priority to ensure availability of offices and mentioned resources. The elected representatives are deprived of rightful legal honoraria and other benefits since their assumption of charge of offices. He further stated that the rent of offices of VC/NC has been enhanced, notification issued but not implemented.
The Movable and Immobile properties of Tehsil and City Local Governments have been occupied or possessed by other departments or officers which shall be handed over to the respective local governments as enumerated under local government act. The P&D guidelines may be amended and thereby Chairman/ Mayor shall be appointed as Chairman Tehsil/ City Development Committee as approved by the previously elected Provincial Cabinet. The present formation is in deviation from the decision of the Provincial Cabinet.
Establishment of Tehsil offices of devolved departments at Tehsil level must be ensured in the shortest possible time. Nomination of Tehsil Chairmen and Chairmen NC/VC in BOGs , BODs, DRCs and other committees , boards at Tehsil, VC / NC level . Transfer of pending property / UIP tax to Tehsil Governments. Extension of tenure of Local Governments for further two years due to dysfunctional in previous two years.
