ISLAMABAD : Supreme Court (SC) while summoning FBR report in respect properties of family members of Justice Qazi Faez Isa in London has adjourned the hearing of the case for further one day.
\nA 10-member bench of SC presided over by Justice Umar Ata Bandial took up Presidential reference review case for hearing Monday.
\nJustice Qazi Faez Isa argued as petitioner that Supreme Judicial Council (SJC) conducted the proceedings behind the back. Reference was challenged after SJC this attitude. Tax Commissioner conducted inquiry into the matter while the court had sought report from Chairman FBR. I was not provided copy of FBR report. FBR report has been kept as state secret. Government wants I am sacked in any way.
\nHe further said request was made in the court on several occasions to adjourn the hearing to delay my case. Farogh Naseem said about my wife on June 22, 2020 that the wife becomes satti after death of her husband in Hindu religion. Farogh Naseem ridiculed the women.
\nJustice Umar Ata Bandial remarked we have to see what allegations are being leveled by you.
\nJustice Faez Isa said this is not allegation but it is part of court\u2019s record. It is my request let me complete my arguments.
\nJustice Umar Ata Bandial remarked \u201c keep your voice low. This is a court.
\nJustice Faez Isa said Farogh Nasim lied before the court. Please hear first what my wife says and then I will complete my arguments. I regret with the court for going emotional.
\nSarina Isa said in the court audio recording of the hearing was sought which was not provided to her.
\nJustice Umar Ata Bandial remarked there is no doubt that you have been affected by court\u2019s decision. Court had ordered to provide audio recording. It is not case of illegality but it is case of sources of income. <\/p>\n
Justice Qazi Faez Isa said Farogh Nasim committed offence by telling lie in the court. Farogh Nasim sarcastically said was property of such pounds made through sewing machine.
\nHe said Sarina Isa be allowed to give arguments due to her personal piece of work.
\nSarina Isa said that she and her children were mentioned in the prime case for 194 time. We were not respondents in the central case. Our family members were ridiculed at public level.
\nJustice Umar Ata Bandial remarked transcript of your talks is there in prime case. You are third party in this case. You were given opportunity to defend yourself. You have no direct link with this case.
\nJustice Qazi Faez Isa said SJC had given him notice but he was not given right to his full defence. The report about my not going to SJC runs contrary to the fact. I have not given a single application for adjournment of SJC proceedings.
\nSarina Isa told the court transcript record of the case has not been provided to her by registrar SC.
\nJustice Umar Ata Bandial remarked providing case record and transcript was court\u2019s decision. Has you paid the penalty amount imposed by FBR.
\nSarina Isa said she has not paid penalty.
\nJustice Umar Ata Bandial remarked have you challenged FBR order.
\nSarina Isa said yes she has challenged FBR order at proper forum.
\nShe said when foreign properties were purchased then her children were adult. Why Prime Minister (PM) Imran Khan is not showing assets of his three wives and 3 children. PM Imran Khan does not come upto article 62. SC said in the decision of presidential reference case Income tax clause 116 is vague. I am paying tax since 1982. How many people present in the court room are paying tax since 1982.
\nJustice Munib Akhtar remarked it has been said in FBR report that there is contradiction in your statement. It is your stance one foreign property is owned by you and the remaining two properties are owned by your children. FBR is saying you are 50 percent share holder in the remaining two foreign properties. Reply to this question was not given in FBR.
\nSarina Isa told that bank staff had filled the forms and she had signed them only. One foreign property is my property and in the remaining two properties I am share holder. I have given 100 percent reply. My stance has never been changed.
\nJustice Munib Akhtar remarked the question is of source of funds.
\nSarina Isa said former chairman FBR Jahanzeb Khan did not approve investigation against Justice Qazi Faez Isa. He was removed from his office for not according approval to hold investigation against Justice Qazi Faez Isa. Jahanzeb Khan had fulfilled the illegal demand of Shahzad Akbar.
\nShe said FBR commissioner had maintained I was involved in concealment of assets. Shahzad Akbar is PTI member and a non elected person.
\nShe said the court should expunge observation given in respect of me in the decision. Shahzad Akbar Khan is running parallel government. I and my children are not dependent on Justice Qazi Faez Isa. Imran Khan too had not shown his wife and children assets. How Imran Khan stay as PM. Imran Khan did not speak truth in his tax returns.
\nJustice Umar Ata Bandial remarked you will have to understand the reference has been nullified by the court.
\nSarina Isa said she has provided record of London properties to the SC. FBR did not include the money acquired out of sale of Karachi property. The court adjourned the hearing of the case till Tuesday. <\/p>\n","protected":false},"excerpt":{"rendered":"
