The Khyber Pakhtunkhwa (KP) government would cut one of its ministers from the cabinet under constitutional requirement as the numbers of ministers exceeded the defined number of 16 to 17 ministers.
\nProvincial Minister for Labor, Shaukat Yusafzai on Monday informed that Advocate General would explain the constitutional point in Provincial Assembly and whatever the suggestion was received the government would take decision according to the law and constitution.
\nThe objection on the numbers of ministers in KP cabinet was raised by the opposition during the Provincial Assembly session that was agreed upon by the Law Department and Advocate General KP.
\nGovernment sources said following constitutional restraint, one of the ministers would be de-notified and made Advisor to the Chief Minister KP.
\nThe issue was raised by Pakistan Peoples Party\u2019s (PPP) Member from Dera Ismail Khan Ahmad Kundi on Friday, on point of order, termed the KP cabinet \u201cunconstitutional\u201d as it exceeds the constitutional limit. Kundi has said that the KP cabinet has 17 members including Chief Minister Mahmood Khan but according to the Constitution, the provincial cabinet should have 11 percent of the total strength of assembly membership or maximum up to 16 members thus the KP cabinet is \u201cunconstitutional\u201d.
\nKundi added that the proceedings of the assembly are also against the constitution, meanwhile speaker assembly Mushtaq Ahmad Ghani responded that some technical and law-related issues exist but the proceedings of the assembly are constitutional.
\nGhani in is his ruling, asked the attorney general of KP to attend the Monday proceedings of assembly and guide the assembly according to law and then necessary actions will be taken.
\nLeader of the opposition, Akram Khan Durani said that Chief Minister and his principal secretary should have a look into the matter at the time of constituting the cabinet. He argued that members of an \u201cunconstitutional\u201d cabinet are getting salaries and benefit from the government exchequer.
