Islamabad High Court (IHC) has remarked parliament can issue no order against the court\u2019s decision without legislation. <\/p>\n
The case against the reinstatement of employees of Pakistan Agriculture Research Council (PARC) under the orders of Public Accounts Committee (PAC) came up for hearing before single bench of IHC led by Chief Justice (CJ) Athar Minallah Wednesday. <\/p>\n
The court sought details of all employees from chairman PARC. <\/p>\n
The court remarked we respect the parliament. But parliament cannot issue any order against the court\u2019s decision without enacting legislation. Division bench gave a decision and it can be abolished only through legislation. PARC is not paying pension to its retired employees and on the other hand it reinstated employees. Division bench had given decision about the employees who were laid off. The employees were reinstated under whose orders. PARC has written what in joining order. People basic rights are being affected due to it. <\/p>\n
The court while addressing PARC remarked \u201c there is auditor general report that you are not paying pension. <\/p>\n
The counsel for PARC told the court that PAC was not authorized to issue order to reinstate the employees against the court orders. But I want to make a clarification in this regard. <\/p>\n
Umar Ijaz Gilani counsel for the petitioner told the court every one is agreed. Speaker, parliament or PAC cannot issue order against the court order. PAC had not issued order for reinstatement. Chairman has given wrong explanation. <\/p>\n
