Islamabad High Court (IHC) has given time till Monday to Rana Shamim former Chief Judge (CJ) Gilgit-Baltistan to file affidavit in contempt of court case. <\/p>\n
IHC Chief Justice (CJ) Athar Minallah has remarked if Rana Shamim does not file his affidavit till Monday then he will be indicted. <\/p>\n
The contempt of court case came up for hearing before IHC bench led by\t CJ Athar Minallah Tuesday. <\/p>\n
During the hearing of the case the CJ IHC inquired from Rana Shamim has he filed affidavit. <\/p>\n
Rana Shamim told the court he had given his reply to his counsel four days before. His counsel is reaching and he will file the reply. <\/p>\n
The court remarked Latif Afridi is amicus curie from this court as well. Latif Afridi has given sacrifices and we will benefit from them. <\/p>\n
Latif Afridi told the court \u201c I have struggled the whole life long for the independence of judiciary and rule of law. According to my view point the political matters should not come in the courts. My client affidavit was a secret document. <\/p>\n
The CJ IHC inquired \u201c where is original affidavit. Question has been raised on the impartiality of my judges. I have never given any one access to myself the whole life. \tMy doors remained shut for every one. The court should be told what are the responsibilities for reporting by news paper. <\/p>\n
Rana Shamim said during previous hearing he had not given affidavit to any news paper. Can any news item be published without any responsibility. <\/p>\n
The amicus curie told the court it is imperative to obtain stance from all the parties concerned before publishing any document. In this case their stance from registrar supreme court and high court has not been sought. <\/p>\n
Rana Shamim said this was a secret document and it was not kept for publication. If Rana Shamim document is private then contempt of court case cannot be made against him. <\/p>\n
The court inquired has amicus curie Reema Umar come. The contempt of court proceedings is not designed for saving the honor of any judge. <\/p>\n
The court remarked \u201cAttorney General (AG) Sahb do you know why there is a stick in the hands of Latif Sahb. This stick is symbol of his struggle for rule of law. <\/p>\n
\u201cLatif Afridi Sahb I make you understand the matter first of all. We judges can not hold press conference. We can not give clarification. The impression was given a specific person should not be released before election. Judges were pressurized . Publishing this affidavit is part of this narrative. Rana Shamim said a former \tChief Justice of Pakistan (CJP) has committed this heinous crime before him.
\nJustice Amir Farooq was on leave in those days when the appeal pleas were heard. . Did the judge who was on leave ensure compromise in respect of the remaining two judges. Bench comprised Justice Mohsin Akhtar Kiani, and Justice Mian Gul Hassan Aurangzeb. The news items like this were published on the occasion of release of Nawaz Sharif. This impression was given that the release has not been made before election but Nawaz Sharif has been released after election. This impression was given all the judges of this high court had compromised. Why it happened so. What Rana Shamim wrote in his affidavit after three years, this impression was given that all the judges of this high court have compromised. Had the conscience woken up he would have filed affidavit any where. <\/p>\n
The court inquired \u201c I am a chief justice. Had any chief justice committed such heinous crime before me then what should I have done. This is a problem when some one sits on chair then there is no conscience. This is problem that the conscience wakes up after long period. <\/p>\n
The court observed no one can influence any one among my judges because they don\u2019t open the door. No one could pressurize Waqar Seth because he did not open the door. This court has nothing to do with former Chief justice of Pakistan Saqib Nisar. This is issue of leveling allegations against the judges who were included in the bench which was hearing appeals. <\/p>\n
The court remarked first of all Rana Shamim will have to prove his good intent by presenting his affidavit. If Rana Shamim does not file affidavit till Monday then we will indict him. <\/p>\n
