Islamabad High Court (IHC) has ordered federal government to take effective measures regarding enforced disappearances. <\/p>\n
The case of missing journalist and blogger Mudassar Naro came up for hearing before single bench of Islamabad High Court (IHC) presided over by Chief Justice Athar Minallah Tuesday.<\/p>\n
Attorney General (AG) Khalid Javed Khan told the court that no positive result came out despite all efforts.
\nAg told the court that meeting of family members of Mudassar Naro was arranged with the Prime Minister (PM) Imran Khan. Several people went missing during the last decade but they don\u2019t come in the ambit of enforced disappearances. Most of the people left the country for Jehad. Pakistan had to face terrorism. Some people are in the detention centre of KP. <\/p>\n
The court remarked these people were lifted under a policy of federal government. What will you say on it. <\/p>\n
AG said the incumbent government has not framed such policy. <\/p>\n
The court remarked why the federal government did not take action. <\/p>\n
AG said a law was enacted about detention centers and the matter remained under hearing in Supreme Court. <\/p>\n
CJ remarked now the government is doing what. Constitution and law are in place. <\/p>\n
AG told the court a new law is being introduced. <\/p>\n
Father of missing person told the court my two sons were students of International Islamic University who were lifted in 2016. One was studying in LLB and second was studying in mass communication department. The FIR Of the incident was registered under the order of enforced disappearances commission. Commission said in the light of JIT report this is enforced disappearances case. <\/p>\n
The court remarked only this job is left with commission that it should register FIR of enforced disappearances. Two boys were lifted in the broad day light from the federal capital in the presence of people. <\/p>\n
AG said he has no reply to it what happened in the investigation. Hundreds of people are on roads against enforced disappearances. Employee of SECP was lifted. A journalist was lifted whose CCTV footage is available. Nothing happened. <\/p>\n
The defence counsel said there are 8279 cases of missing persons. <\/p>\n
The court remarked the court should hold responsible whom. <\/p>\n
The court remarked the armed forces can do nothing without the approval of federal government as per constitution. Summoning any one here is not solution to the problem. Tell this court its solution. <\/p>\n
AG said that it was not policy of Nawaz Sharif, Yousuf Raza Gillani and Imran that people be lifted. If some one is punished once then a good message will go. We can start from the case wherein CCTV footage is available. <\/p>\n
The court inquired tell us how should we go forward in this matter. <\/p>\n
AG told the court if some one is identified and chief executive does not take action then he is answerable. <\/p>\n
The court remarked one chief executive wrote in his book it was policy. <\/p>\n
AG told the court he was usurper. He should not be equated with the elected chief executives. He was showing fist. Now he is absconding . . It is easy for me to say that the chief executive should be held responsible during whose tenure enforced disappearances took place. I will not say so. <\/p>\n
The court remarked a clear message should come from federal government that this matter will not be tolerated. <\/p>\n
AG remarked we should come to know that this message has to be given whom. <\/p>\n
The court remarked it is difficulty in enforced disappearances case that when state itself is involved then who will investigate the matter. This court or defence counsel or some one else can not investigate. Should we give more time to you for giving clear message on behalf of federal government.
\nThe court while accepting the plea of AG gave three weeks more time for effective investigation of the case besides adjourning the hearing of the case till February 14. <\/p>\n","protected":false},"excerpt":{"rendered":"
