\nHimayatullah Mayar, Mayor Mardan strongly criticized the provincial government for reducing the power of Mayor and Chairman through amending the section 23-A and 25-A of the local government act 2013. \u201cAccording to the 2001 ordinance and 2003 local government act authority should be given to elected members\u201d, he added.
\nHe expressed these views while addressing the tehsil council Mardan session held at Town Hall. Mayor added that the developing countries focus on local government to Improve democratic system. He argued that they are elected by the public and we are answerable to the public but without power we cannot serve our people.
\nHimayatullah Mayar told the session that the Provincial government neither creates PFC nor elect members for it which is un-justice with the elected members. He added that the people have expectations from elected members but without authority we are not able to face them as well as cannot satisfy them. The provincial government is violating the local government act and constitution. \u201cWe are going to start a great movement against the provincial government from Mardan and we will hold a great convention in which all the mayors and chairmen of other districts of the province will participate. Mayor added that a strong local government is necessary for progress, development and a better democratic system on local level.
\nHimayatullah Mayar said that section 23-A and 25-A of the local government act 2013 clear the powers of Mayor and chairman. He added that the provincial government has amended section 23-A and 25-A and reduced the power of Mayor and chairman. He argued that it is a violation of article 148 of the constitution of Pakistan. He added that under the local government act 2013 the power of the selection of presiding officer was with the Mayor and chairman. However, they changed the name of the presiding officer into a convener and gave the power to house now house will have selected the convener which is also illegal.
\nHimayatullah Mayar added that however these all amendments in the local government act are totally illegal. He argued that through which act the local government was elected they will work under that act. He added that by law, this act cannot be amended. He added that the new amendments in the act will be implemented by other local government which elect under this act. Himayatullah Mayar argued that according to the law, the amended act cannot be implemented on the existing local government system.
\nThe existing local government system will work under the old act. Mayors and chairmen of other Tehsil of the district also attended the session and expressed their views in the session regarding strengthening of local government. At the end of the session the elected members staged a protest rally outside the Commissioner office against the provincial government.
