Chief Justice of Pakistan (CJP) Umar Ata Bandial remarked Wednesday what had happened on May 25 should not happen again. <\/p>\n
\u201cthe life of 2 lac people can not be made miserable by calling 10000 people. The followers of democracy don\u2019t voice protest this way. Court is exercising too much restraint. There is enough material to give notice to Imran Khan. Despite it we are giving another chance for explanation, he further remarked.
\nA five members bench of SC presided over by CJP Umar Ata Bandial took up for hearing contempt of court case against the former Prime Minister for violating court May 25 order Wednesday. <\/p>\n
President Supreme Court Bar Association (SCBA) Ahsan Bhoon appeared in the court saying \u201c I am representing Babar Awan and Faisal Chaudhry. Notices were issued to Babar Awan and Faisal Chaudhry.<\/p>\n
The CJP remarked the court had not sent notices. It had only sought replies. The replies from the two lawyers are appropriate obviously. We will review the replies later. First of all we hear the stance of law officer. <\/p>\n
Additional Attorney General (AAG) Amir Rehman said Imran Khan has sought time to file detailed reply. Imran Khan has shown ignorance about any assurance. Imran Khan in his reply has shown ignorance about court\u2019s order. <\/p>\n
Additional Attorney General (AAG) said assurance was given by Imran Khan. According to Faisal Farid Chaudhry Asad Umar had issued directives. According to Faisal Choudhry contact between him and Imran Khan could not be made. According to Babar Awan no lawyer had mentioned the name of Imran Khan. <\/p>\n
Faisal Chaudhry said court\u2019s order had come at 6 P.M evening. <\/p>\n
Asad Umar told application has been given to the administration for H-9 ground. <\/p>\n
The CJP remarked on May 25 the court gave first order at 11 a.m and second at 6 pm evening. The time between the two orders was meant for seeking directives. The court was not told from whom the directives were obtained. If no talks were made with any one then why the court was not informed. Explanation in this regard will have to be given. The court had expressed confidence on Babar Awan and Faisal Chaudhry. These two lawyers had never said that they have not received directives. We will have to see how Imran Khan came to know about the court\u2019s orders. The assurance was made from the top leadership of PTI which starts from Imran Khan. <\/p>\n
The lawyer Ahsan Bhoon took the plea the government did not arrange meeting of Imran Khan with his lawyers under court orders. <\/p>\n
The CJP remarked when the lawyers could not make contact then assurance was given from which side. Had lawyers not talked to senior leader. Was there no telephonic contact.<\/p>\n
Faisal Chaudhry told the court contact was made with Asad Umar and Babar Awan and they were informed about court\u2019s proceedings . <\/p>\n
The CJP remarked Asad Umar was in rally as per pictures. The media was present in court\u2019s room. The court order was broadcast on media all over the country. Should the court not believe what the lawyer has said.
\nThe CJP remarked the court had issued directive to government on PTI assurance. The lawyers should have been present in H-9 ground. Should court ask from Imran Khan now what had happened. <\/p>\n
The CJP remarked the Attorney General was seized with apprehension that law and order situation will be created.
\nFaisal Chaudhry said the court had prohibited from talking to media. <\/p>\n
The CJP remarked the court had tried to forge balance on May 25.Contact could be made for the second time with Asad Umar but it was not done so. This is the reason the court remarked in its May 26 order that court confidence was shaken. <\/p>\n
Justice Ijaz ul Ahsan remarked PTI misused court\u2019s order. <\/p>\n
During it the court sought reply from Imran Khan within one week. . <\/p>\n
CJP remarked we will fix the next hearing of the case after one week.
\nJustice Ijaz ul Ahsan remarked the court had provided protection to PTI leadership and workers. The government had removed barricades under court\u2019s order. <\/p>\n
The CJP remarked being a lawyer is matter of honor. Excuses are not made after giving assurance to the court. Non availability of vehicle or aero plane is only a pretext. How could the contact be not made for the second time with Asad Umar. The court was misguided through two lawyers. We don\u2019t want to use our pen against the constitution. Patients had died in ambulance during Faizabad Dharna. <\/p>\n
