{"id":325435,"date":"2023-04-13T05:55:52","date_gmt":"2023-04-13T00:55:52","guid":{"rendered":"https:\/\/leadpakistan.com.pk\/news\/?p=325435"},"modified":"2023-04-13T14:52:09","modified_gmt":"2023-04-13T09:52:09","slug":"top-court-issues-notices-to-officials-over-delay-in-funding","status":"publish","type":"post","link":"https:\/\/leadpakistan.com.pk\/news\/top-court-issues-notices-to-officials-over-delay-in-funding\/","title":{"rendered":"Top court issues notices to officials over delay in funding"},"content":{"rendered":"<p>Punjab polls<br \/>\nSays non-provision of funds for holding elections is \u2018prima facie disobedience\u2019<br \/>\n ISLAMABAD<br \/>\nThe Supreme Court on Wednesday issued notices to several officials, including the attorney general for Pakistan (AGP) and the secretary of finance, over the delay in the release of funds for holding elections to the Punjab Assembly.<br \/>\nA three-member Supreme Court bench, headed by Chief Justice of Pakistan (CJP) Umar Ata Bandial, had directed the electoral body to hold elections in Punjab on May 14, and the federal government to provide funds amounting to Rs21 billion to ECP by April 10.<br \/>\nHowever, the Election Commission of Pakistan (ECP) submitted a report to the apex court on Tuesday stating that the federal government had not provided funds for the polls.<br \/>\nSubsequently, the apex court issued notices to the AGP, finance secretary, ECP secretary, ECP director general (law) and State Bank of Pakistan (SBP) governor to appear for an in-chamber hearing at 11am on April 14.<br \/>\nThe notice stated that non-provision of funds for holding the polls was \u201cprima facie disobedience\u201d. \u201cThe consequences that can flow from such prima facie defiance of the court are well-settled and known.<br \/>\n\u201cEvery person who embarks upon, encourages or instigates disobedience of the court can be held liable and accountable.\u201d The notices stated that provision of funds for holding polls was a more important matter than pursuing a contempt of court case.<br \/>\nThe notice directed the SBP chief to come to the hearing with the record of all resources at the central bank\u2019s disposal. It also directed the finance secretary to come to the court with records.<br \/>\nThe ECP secretary was also asked to bring all records related to polls for Punjab and Khyber Pakhtunkhwa assemblies. The government on Monday tabled a bill seeking approval of funds for the elections in both Punjab and Khyber Pakhtunkhwa.<br \/>\nAs per the decision of the federal cabinet, Finance Minister Ishaq Dar introduced the money bill, saying that the government was laying the bill before the house in light of the Supreme Court orders to release Rs21 billion to the ECP to hold a general election in the two provinces.<br \/>\nThe financial czar said the federal cabinet, in its recent meeting, pondered over the SC orders and, in view of the house\u2019s resolution, sought Parliament\u2019s will to take a final decision regarding the allocation of funds for the Punjab and KP general elections.<br \/>\nThe move came after the top court had declared the ECP\u2019s decision on the Punjab and KP elections null and void, while ordering it to hold snap polls \u2014 a persistent demand forced by Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan after he dissolved the assemblies in both the provinces.<br \/>\nThe apex court had given the date of May 14 for the polls in Punjab.
