\nFederal government has filed written reply in Supreme Court (SC) in the case against trial of civilians in military courts.
\nThe reply comprising 31-page has been filed by Attorney General (AG).
\nThe federal government took the plea in the reply the petitions filed in SC against military courts are not maintainable because the petitioners resorted to SC directly instead of high courts.
\nFederal government said army act and official secret act are already there in the constitution of Pakistan which have not been challenged so far. All the steps taken under these acts are correct as per law.
\nThe federal government requested that SC should not hear this case directly because if SC dismisses these petitions then it is feared that the right of affected respondents is affected in the high court.
\nThe federal government once again requested for constitution of full court saying full court should hear the case against the military courts.
\nJustice Yahya Afridi has already given opinion for constitution of full court.
\nFederal government clarified in written reply that trial of whose among those arrested in connection with May 9 incidents will run in military courts
\nTrial of all those involved in May 9 incidents will not be conducted in military courts. But the trial of only those personal will run in military courts who come under official secret , who had entered into prohibited installations and attacked them.
\nIn its reply the federal government while declaring the trial of civilians in military courts as per law and constitution requested that the petitions pending hearing against military courts be rejected.
\nFederal government has said in its reply that attacking military and defence installations and institutions is direct attack on national security of Pakistan. Constitution allows to run cases under army act against those involved in attacks on national security. Stern action is needed against those found responsible to prevent such attacks. Constitutional rights don\u2019t stand curbed due to trial in military courts. Military installations were targeted in organized manner on May 9. Attacks on military installations was to undermine national security and army. Attacking military properties all over the country within short time is evidence of organized plan. Corps commander house, GHQ, PAF base were attacked simultaneously at 5.30. Loss has been caused over Rs 2 billion in incidents during May 9 tragedy.
