{"id":347744,"date":"2023-08-08T08:47:32","date_gmt":"2023-08-08T03:47:32","guid":{"rendered":"https:\/\/leadpakistan.com.pk\/news\/?p=347744"},"modified":"2023-08-08T08:47:32","modified_gmt":"2023-08-08T03:47:32","slug":"pti-moves-supreme-court-against-toshakhana-verdict","status":"publish","type":"post","link":"https:\/\/leadpakistan.com.pk\/news\/pti-moves-supreme-court-against-toshakhana-verdict\/","title":{"rendered":"PTI moves Supreme Court against Toshakhana verdict"},"content":{"rendered":"<p> ISLAMABAD<br \/>\nThe Pakistan Tehreek-e-Insaf approached the Supreme Court of Pakistan on Monday to declare Additional District and Sessions Judge (ADSJ) Humayun Dilawar\u2019s judgement in Toshakhana case \u201cnull and void\u201d.<br \/>\nAccording to the petition filed by the PTI in accordance with Article 184(2) of the Constitution, the PTI chief wasn\u2019t granted a fair trial hence the Toshakhana case should be reheard. \u201cA fundamental right under Article 10A, The Right to a Fair Trial, has been denied to PTI chairman in relation to his conviction in the Toshakhana case,\u201d the petition read.<br \/>\nThe PTI chief was detained and sent to Attock jail on August 5 after being found guilty by a district and sessions court in Toshakhana case. ADSJ Dilawar issued an arrest warrant for Khan and sentenced him to three years in prison and imposed a Rs100,000 fine.<br \/>\nThe PTI claimed that the ruling was rendered hastily, in PTI\u2019s chief absence and \u201cin complete disregard\u201d of the Islamabad High Court\u2019s (IHC) orders. \u201cThe maintainability question was expressly referred back to the learned additional sessions judge in that decision of the honourable Islamabad High Court dated Aug 4 with instructions to resolve it again. \u201cHowever, undermining this directive, the learned judge bypassed any fresh decision-making and dismissed the application in violating haste and without objective evaluation of the case, subverting principles of natural justice,\u201d the petition read.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD The Pakistan Tehreek-e-Insaf approached the Supreme Court of Pakistan on Monday to declare Additional District and Sessions Judge (ADSJ) Humayun Dilawar\u2019s judgement in Toshakhana case \u201cnull and void\u201d.
