{"id":491084,"date":"2025-07-19T09:00:21","date_gmt":"2025-07-19T04:00:21","guid":{"rendered":"https:\/\/leadpakistan.com.pk\/news\/?p=491084"},"modified":"2025-07-19T09:00:21","modified_gmt":"2025-07-19T04:00:21","slug":"ec-others-put-on-notice-on-petition-against-declaring-pti-members-of-assembly-independent","status":"publish","type":"post","link":"https:\/\/leadpakistan.com.pk\/news\/ec-others-put-on-notice-on-petition-against-declaring-pti-members-of-assembly-independent\/","title":{"rendered":"EC, others put on notice on petition against declaring PTI members of assembly independent"},"content":{"rendered":"<p> PESHAWAR<br \/>\nPeshawar High Court (PHC) has issued notice to Election Commission (EC) and other respondents on the petition against declaring the members of assembly from PTI as independent.<br \/>\nThe petition filed by Chief Minister (CM) KP Ali Amin Gandapur against EC for declaring PTI members of assembly as independent came up for hearing before a two members bench of PHC comprising justice Sahibzada Asad Ullah and Justice Farrukh Jamshed Friday.<br \/>\nDuring the hearing of the case, Bashir Khan Wazir advocate counsel for the petitioner took the plea that EC has declared PTI members of assembly as independent.<br \/>\nCM KP Ali Amin Gandapur and others contested the election on the ticket of PTI and they did not join any other party .<br \/>\nAdvocate General (AG) Shah Faisal Itteman Khel took the plea in the court that election symbol was withdrawn from PTI after Supreme Court (SC) decision and PTI candidates participated in election under different election symbol. SC has not declared PTI a non political party in its decision. EC misinterpreted SC decision. According to election act -2017 party does not stand abolished due to withdrawal of election symbol.<br \/>\nHe further said in his arguments political party stands abolished due to withdrawal of election symbol in Election Rules-2017. EC relied on it and declared PTI members independent. if rules clash with act then act will be given preference. PTI candidates have won more seats than all others in election in KP.
