Division bench compromising CJ Dogar, Justice Azam rules Justice Jahangiri\u2019s appointment illegal
\n ISLAMABAD
\nIslamabad High Court (IHC) while declaring the degree of serving judge Justice Tariq jahangiri fake has ordered to denotify him from the office of judge.
\nA division bench of IHC comprising Chief Justice (CJ) IHC Sarfraz Dogar and justice Azam Khan announced the decision of degree case.
\nThe court ordered law ministry to denotify Tariq Mehmood Jahangiri.
\nIt was said in the meeting Tariq Jahangiri did not hold valid degree of LLB at the time of his appointment as judge. His appointment as judge was illegal. He was not eligible to become judge.
\nThe court approved the petition filed by Mian Dawood advocate against justice Tariq Jahangiri and rejected the petitions filed by justice Tariq Jahangiri.
\nThe petition filed by Justice Tariq Jahangiri for formation of full court was rejected. His petition for adjourning the case till the decision of Sindh high court was also rejected. His petition regarding objection on bench was also dismissed.
\nJustice Tariq Jahangiri degree case came up for hearing. Barrister Salah ud Din, Akram Sheikh , Raja Aleem Abbasi and others gave arguments. Judges moved to chambers after hearing the arguments.
\nThe petitioner Mian Dawood advocate gave arguments .
\nBarrister Salah ud Din gave arguments on two applications while Akram Sheikh gave arguments on one petition.
\nBarrister Salah ud Din requested the court to adjourn the case for indefinite period taking the plea 30 days period be given for filing the reply. This matter falls in jurisdiction powers of Sindh High Court (SHC). This case is not maintainable in this court. I am not giving arguments on merit and am giving arguments on my petitions.
\nBarrister Salah Ud Din said it has been propagating since the last one and half year that the degree is fake. Today registrar Karachi university admitted here that he was present in LLB part-1, 2 and 3. Registrar Karachi university said this there was irregularity in the process of his degree.
\nHe further argued Karachi university admitted it issued degree which was cancelled. Registrar Karachi university admitted this is not case of fake degree but it is case of cancellation of degree on irregularity.
\nHe argued this has yet to be decided that Karachi university is speaking the truth after 40 years or not.
\nRegistrar Karachi university did not raise objection over stay order in SHC.
\nBarrister Salah ud Din said Karachi university filed reply in IHC but it concealed that SHC has cancelled declaration. Contempt of court plea has been filed in SHC against Registrar Karachi university for concealing the facts. SHC has suspended all the proceedings including declaration of Karachi university.
\nHe argued this court cannot move ahead proceedings of the case in this situation.
\nChief justice inquired from barrister Salah ud Din have you not filed reply so far.
\nBarrister Salah ud Din said the record from HEC was received at 3 P.M yesterday.
\nThe CJ IHC said you have filed reply in SHC but why you are not filing reply here.
\nJudges went to chamber after hearing the arguments of the lawyers and announced the judgment at 3.30.
