Contempt of court case
\n ISLAMABAD
\nIslamabad High Court (IHC) has summoned DG Immigration and Passport Muhammad Ali Randhawa in contempt of court case for not removing name of citizens from Passport Control List (PCL) despite court\u2019s orders.
\nJustice Azam Khan while cautioning has said we are giving time till Monday. Implementation report be presented. Then decision will be made. If we give contempt of court notice then no unconditional apology will be accepted. 16 contempt of court petitions are pending hearing only in my court. While over 100 petitions are pending hearing in high court.
\nJustice Azam Khan issued orders on the petitions of Afnan Khan, Khurram Shahzad and Hadi Hussain. Assistant Attorney General (AAG) Raja Zamir ud Din and counsels for the petitioners appeared in the court. The counsel for the petitioner took the plea the court\u2019s orders have not been implemented. The names of the petitioners are still on PCL due to which contempt of court plea has been filed.
\nThe court while summoning DG Immigration and Passport announced interval in the hearing.
\nJustice Azam Khan resumed the hearing.
\nDG Passport and Immigration Muhammad Ali Randhawa appeared in the court Justice Azam Khan said 16 contempt of court pleas are pending hearing only in his court. The counsel said interior ministry has constituted a committee which will see high court order. Justice Azam Khan said if there is such law then he should be told. The counsel said the committee assignment is to decide about removing or not removing the name from PCL. Justice Azam Khan said contempt of court notice will be issued if court\u2019s orders are not implemented.
\nThe counsel told the court the cases which have come in this court have been placed before committee. Committee has to decide about 346 cases. Minutes of meeting are awaited.
\nJustice Azam Khan said this cannot be said that committee scrutiny will make court decision .
\nCounsel for DG Immigration and passport sought time of two days from court telling decision about Afnan Khan has been implemented.
\nCounsel for the petitioner said private counsel cannot appear on behalf of some government department. when state counsel is present then how can private counsel appear.
\nThe counsel said it was court\u2019s decision that name be removed forthwith form PCL.
\nIHC directed to implement court\u2019s order till Monday.
\nJustice Azam Khan said we are giving time till Monday. Present implementation report. Then decision will be made. If we give contempt of court notice then no unconditional apology will be accepted.
