US national approaches PHC for citizenship

A national of the United States of America (USA) on Thursday filed a writ petition before Peshawar High Court (PHC) seeking directions for the federal government and relevant authorities to grant nationality to him on virtue of his marriage to a Pakistani national.
Saifullah Muhib Kakakhel advocate filed the writ petition on behalf of the US national petitioner and his wife.
The counsel pleaded in the petition that the US national is a convert to Islam from Christianity and have married a Pakistani national from Peshawar and is currently residing at Peshawar.
The counsel pleaded that the US National wishes to get Pakistani nationality with his religion as Islam so he can perform Haj and umrah because his US passport remains in his former religion of Christianity.
The counsel pleaded that every person born in Pakistan or married to a Pakistani man or woman is entitled to nationality by virtue of international Law on the subject to which Pakistan is a signatory.
The counsel pleaded that the Pakistan Tehreek-e-Insaf (PTI) government had time and again said that foreign nationals will come to Pakistan, and the present case is an outcome of recent progressive policies and good reputation created by the country.
The counsel pleaded that by virtue of Pakistan Citizenship Act, 1951 and recent Judgements of PHC, every person married to a Pakistani national woman is to be granted nationality or Pakistan Origin Card.
