As to why judge at No 15 was transferred by leaving 14 judges: SC

Supreme Court (SC) has indicated to complete the hearing of judges seniority and transfer case today (Thursday) and issue short order.
Justice Naeem Akhtar Afghan remarked in Zulfiqar Ali Bhutto case the judges kept on saying the lawyers to complete the arguments soon and not to delay them. The case became delayed due to lengthy arguments of the lawyers. Judges kept on retiring and due to retirement of judges the composition of judges underwent change.
In this case the question is this as to why judge at No 15 was transferred by leaving 14 judges. Judges of special court which is constituted under judicial council or article No 6 are there for specific period. But the question is this transfer of judge under article 200 is permanent or temporary.
He raised the questions and gave remarks on Wednesday.
SC constitutional bench headed by justice Muhammad Ali Mazhar heard the case.
Advocate General (AG) Punjab Amjid Pervaiz said that previous service of the judges was recognized always at the time of transfer in the past. Special court was constituted for trial of Pervaiz Musharraf in high treason case. 3 judges from high court were included therein. Senior most judge among them was made head of the bench.
Justice Naeem Akhtar Afghan inquired judges of special court constituted under judicial council or article 6 are for specific period. But question is here if the transfer of judge under article 200 is of permanent or temporary nature.
He said Attorney General (AG) has made it clear the judges have been transferred on permanent basis.
AG Amjid Pervaiz said that he will give arguments about transferring judge.
Justice Naeem Akhtar Afghan raised the question why the judge at No 15 was transferred by leaving 14 judges.
Amjid Pervaiz replied this summary was not worked out by common man but it was prepared by Judges. Judges are well aware of law and constitution.
He said where additional judge is needed by chief justice high court , period is mentioned therein. But transfer is made on permanent basis. Following completion of arguments by AG Punjab, Idrees Ashraf counsel for PTI founder started his arguments.
The court adjourned hearing of the case till today (Thursday).
