Alleged fake degree case
ISLAMABAD
Islamabad High Court (IHC) has prevented Justice Tariq Mehmood Jahangiri from performing judicial work in alleged fake degree case.
Chief Justice (CJ) IHC Sardar Sarfraz Dogar and justice Azam Khan gave a big decision and appointed two amici curiae including advocate Barrister Zafar Ullah Khan and former attorney general Ashtar Ausaf.
The court issued notice to Attorney General (AG) for providing assistance to court.
Assistance has been sought from AG on the maintainability of the case.
The court has issued written order in this regard. CJ IHC Sarfraz Dogar and Justice Azam Khan heard the case on Tuesday. The court adjourned the case till the decision of Supreme Judicial Council (SJC)
The court said in its decision the case will remain pending hearing in IHC till the decision of SJC. There is important question before the court which has to be seen. when the matter is pending hearing in SJC then can the high court be resorted to.
It is pertinent to mention here the petition was filed by advocate Mian Dawood under article 199 of the constitution.
The petition said that the LLB degree of Karachi university in respect of Justice Jahangiri is incredible. Due to it his entire legal career and later his appointment as judge in high court is liable to be declared illegal.
The petitioner has based his stance on formal correspondence with Karachi university which is attached as proof.
This petition was filed in the beginning of this year.
Former CJ IHC Amir Farooq had reserved judgment on the maintainability of the petition.
Now this case has been fixed before a new bench.
