Court rejects Aleema Khan acquittal plea

Anti Terrorism Court (ATC) Rawalpindi has rejected acquittal plea of Aleema Khan sister of PTI founder in November 26 protest case registered against her.
The petitioner , her lawyers and special prosecutor Zahir Shah were present in the court.
Prosecution took the plea that the accused was indicted under 5 different clauses of anti terrorism act. This indictment was framed on the basis of investigation report. Prosecution was of the view the entire control lies with the organizers during the political protest . Theory of control says the entire control is in the hands of accused during any such protest. Media has nothing to do with this case in any way. What media was to make its own prime minister that people did not come out on media appeal. Why should we make media witness when they themselves are admitting they staged this protest. They claim people came out on their appeal. But they are not admitting it before the court.

The petitioner told during his talks with media that former chairman has said if there is NOC of protest or otherwise we will not accept it. Then what type of peaceful protest this was. One policeman was martyred and 170 were injured.
Business activities remained shut in the entire country during this protest. The country was jammed. The accused themselves admit we shut the country during the protest. Armed groups were brought from KP to Punjab during the protest.
Prosecution during their arguments said the statements of 18 witnesses have been recorded in this case. Filing acquittal plea at this phase has no legal justification. It is therefore, requested to court to reject bail plea of Aleema Khan.
Earlier counsel for the petitioner took the plea fault of Aleema Khan is this she met her brother in jail during the protest and she communicated the message of former chairman to party and people.
The counsel of the accused was of the view that it was told in the case Aleema Khan gave message of protest through media. But any journalist or media channel has not been made witness or nominated in this case.
The court inquired you mean media too be entangled in this case.
The defence counsel said I mean to say Aleema Khan and the journalists reported look alike statement. No witness is there about meeting in the jail.
The court further inquired you want to say Aleema Khan gave only message of protest.
The counsel said yes Aleema Khan gave message of peaceful protest.
The counsel for the petitioner said the clauses included in the case don’t prove the allegations leveled against the accused in any way. Nothing like this is written in the law that one who gave message is accused. The clauses mentioned in section 6 of anti terrorism act don’t prove the offence of the accused. In this perspective this case cannot be made. This case is merely a political victimization
The court rejected appeal plea of Aleema Khan after hearing this case.
