SC orders for acquittal of accused in drug recovery case

ISLAMABAD: Supreme Court (SC) while declaring decision of high court and trial court in drugs recovery case has ordered for acquittal of the accused Sardar Muhammad. The SC has issued order if the accused is not wanted in any other case then he should be immediately released. Order said Prosecution failed in proving the case. Due to it SC orders to release him by giving him benefit of doubt, Justice Ishtiaq Ibrahim wrote in written decision clear contradiction is there in the statements of the witnesses. The continuity of safe custody of drugs from its recovery to its shifting to laboratory could not be proved. It has been further said in the decision delay in shifting of case property and vacuum proved fatal for prosecution case. The map and entries of roznamcha (daily diary) were not presented in the court. While the standard of evidence in the cases involving stern punishment should be stern and above doubt. APP
