Court issues notices to president and PM; asks respondents to explain consequences of delaying summary
ISLAMABAD
Islamabad High Court (IHC) has issued notice to President and Prime Minister (PM) for today (Tuesday) through secretaries on the dispute of not approving the summary regarding appointment of judges.
The notices have been issued on the petition against non approval of summary by the president Asif Ali Zardari.
The court has issued notice to law ministry for tomorrow and sought reply.
IHC while seeking reply till tomorrow has questioned summary stands stopped at what stage.
Zahid Asif Chaudhry persuaded the case on behalf of petitioner Luqman Zafar.
Justice Arbab Muhammad Tahir expressed resentment over federal government.
Justice Arbab Muhammad Tahir while addressing Additional Attorney General (AAG) said federal government is doing what. Have you no interest in it. It seems as if federal government has no interest about what is going on.
We thought federal government will discharge its duty but it did not happen so.
Justice Arbab Muhammad Tahir remarked summary is at what stage. Do you know some thing about it. What is happening in connection with appointment of judges of superior judiciary. There was matter of confirmation of judges of Sindh and Pehawar High Court. Judicial Commission had given approval to it and it has also stopped.
Justice Arbab Muhammad Tahir remarked summary can not be kept this way. Earlier 15 days had not passed and now 18 days have passed.
Counsel Asif Raza Chaudhry argued constitution is very clear that when time lapses then what will happen. President cannot keep summary this way.
Additional Attorney General (AAG) Rashid Hafiz said president cannot reject the summary now.
Justice Arbab Muhammad Tahir remarked the matter of powers of president will be seen later. Now federal government should tell it has done what after lapse of 15 days. The matter of appointment of new judges in IHC stands suspended.
The court while seeking reply till tomorrow adjourned the hearing of the case.
