Bhara Kahu by pass project: Powers to change master plan rests only with federal govt: IHC

Islamabad High Court (IHC) while hearing the Quaid-e-Azam University (QAU) professors petition against under construction Bhara Kahu by pass on the land of university has directed federal government to see the matter.

The court observed Additional Attorney General (AAG) should hear all the stake holders till next Friday and inform the court about the matter.

The court extended till next Friday stay order on Bhara Kahu bypass project to the extent of QAU land.

The court remarked if some ambulance has to come from Bhara Kahu then difficulties are faced.

The case came up for hearing before a single bench of IHC led by Justice Miangul Hassan Aurangzeb Friday.

The court remarked this by pass will take ten years time. Come here with such a solution which affects all least. Opportunity should be given to federal government to resolve the matter. We give one week time.

AAG told the court this is public interest matter and we will proceed as per court’s orders.

The court remarked what temporary relief I have given it is burden on my mind. We should not stop on this project for long time.

The court inquired what about master plan. Where is master plan. Tell us.

The map was presented on this occasion under the order of the court.

The court observed map is not master plan. Show us master plan. Has any meeting been held among the faculty members or with CDA.

The counsel for the petitioner told the court mention of Margalla road alongwith Margalla hills is made in master plan which is going side by side with Margalla hills.

The court inquired is the land allocated for university in master plan.

The counsel for the petitioner said yes it is. The land is allocated for educational purposes near national park.

The court remarked the powers for bringing change in master plan rest with only federal government and no one else can change it. As per master plan the entire Bhara Kahu comprises encroachments. If CDA demolishes it then the affectees will not be able to claim the compensation. CDA should interfere in this matter. University too is part of government.

The counsel for CDA told the court environment DEPARTMENT has seen lay out plan and has declared it better than the previous plan.

The court remarked no one is demolishing the university nor the university is being closed. It has been assured that the educational process will not be affected. There should be sub meeting of cabinet and representatives of CDA and university be called therein. The reservations of all respondents should be allayed. Land be arranged for university on Murree road near the university.

The counsel for petitioner told the court earth research department has to be framed for working on CPEC. Northern by pass was to be built which was to pass without affecting Bhara Kahu population.

The court directed AAG THAT federal government input with reference to it be given to court till Friday.

The court adjourned the hearing of the case till Friday.
