CM KP files petition in PHC for orders to declare PTI a political party

Chief Minister (CM) KP Ali Amin Gandapur has moved Peshawar High Court (PHC) seeking court’s orders for declaring PTI a political party. CM KP has filed petition in PHC through Qazi Anwar advocate making federal government and Election Commission of Pakistan (ECP) respondents.
Through this petition rule No 49(4) of Election Rules-2017 has been challenged.
The petitioner has taken plea in the petition that as per rules, it is included in the definition of political party that if there is no election symbol then party having no election symbol will not be party. However the electoral symbol is not compulsory in terms of political party definition laid down in Election Act-2017.
It was further said in the petition that election rules are in clash with the definition of political party laid down in 2017 act.
ECP declared PTI candidates independent on this basis.
It has been said in the petition as per Election Act PTI is a political party. A 13-member bench of Supreme Court has also declared PTI a political party. Election commission has no powers to declare PTI candidates as independent.
