Declaring any one disqualified for life time is not easy: CJP


Chief Justice of Pakistan (CJP) Umar Ata Bandial has remarked declaring any one disqualified for life time is not easy .

“ only court can give the declaration of article 62(1)(f) . No one can be called dishonest without reviewing the evidences. It is not easy to declare some one disqualified for life time. Court’s declaration means evidences be recorded. SC has set the standard in its decisions for application of article 62(1)(f).
The CJP gave these remarks while presiding over 3-member bench of SC during the course of hearing of appeal plea against life time disqualification of PTI leader Faisal Vawda here Thursday.

Wasim Sajjad counsel for Faisal Vawda told the court Faisal Vawda had said to US embassy to leave citizenship.

Justice Mansoor Ali Shah inquired can the citizenship be abandoned on verbal statement.

Justice Ayesha Malik remarked that Faisla Vawda US passport was not cancelled at the time of filing affidavit by him.

The counsel for Faisal Vawda told the court the real question is declaration of life time disqualification which the commission can not give. Article 63 (1)(c) is applicable to dual nationality. The member is deseated on dual nationality and is not disqualified for life time.

The court adjourned the hearing of the case till next Wednesday.
