Executive is so incompetent that it cannot appoint AG: Supreme Court

Supreme Court (SC) has rejected Customs appeal against the vehicle bearing fake number plate.

The case came up for hearing before a 3-member bench of SC presided over by Justice Qazi Faez Isa here Monday.
Justice Qazi Faez Isa remarked during the hearing of the case the powers to grant amnesty rest with parliament or provincial assembly. Province says this vehicle falls in our jurisdiction. Department is sleeping or is selling its posts. No one brings the vehicle in pocket nor it comes flying. When vehicle comes then all start saying how the vehicle came. There is no reply to it. The department should see on Chaman border how does the vehicle come.

Justice Yahya Afridi while addressing counsel for Customs remarked “ you should charge your duties and wrap up the matter.
Justice Qazi Faez Isa remarked court does not enact law but it interprets it.

Justice Qazi Faez Isa once again expressed annoyance over non appointment of Attorney General (AG ) remarking the court had issued an order and the government has not implemented it so far.

He observed tell us who is AG at present.

He remarked government could not appoint AG so far. Executive is so incompetent that it cannot appoint an AG.

Addressing to Deputy AG, Justice Qazi Faez Isa remarked there are 5500 lawyers of SC and you cannot appoint an AG. The post of AG cannot be left vacant as per constitution. Non appointing the AG is blatant violation of the constitution. What Pakistan is left should not be destroyed. Is government bargaining over the appointment of AG. You are destroying the country in organized manner through amnesty. Amnesty has annihilated Pakistan. One time amnesty has taken place 100 times. Every institution is granting amnesty. We are incompetent. We cannot stop vehicles, therefore, we are giving amnesty. We call data from FBR how much amnesty has been granted uptill now. The smuggling of gold and silver is comprehensible but how can the vehicle be smuggled. Still the vehicles with strange numbers are running on Islamabad road. The owners of these vehicles are perhaps very powerful people. Neither Customs department checks them nor police check them. Customs department has made mockery of law. British prime minister was challanned for not wearing seat belt. He apologized. Here you can not challan DC or CDA officer here what to speak of Prime minister.

Later the court rejected appeal plea of Pakistan Customs for confiscating vehicles.
