Govt can acquire land forcibly without the will of owner: SC

ISLAMABAD: Supreme Court (SC) has remarked government can acquire property forcibly without the will of its owner . The SC while releasing an important decision made it clear government is empowered to acquire land in public interest. Government can acquire property forcibly without the will of its owner but this power of the government is not absolute power. According to SC article 23 and 24 of the constitution regulate it for maintaining balance between this mighty power and basic rights. The owner of property be given gold in exchange for gold and not copper be handed over to him. The court maintained in its decision that value of the land be determined not only from government rate but it should be determined keeping in view market value, possible use and development in future. if there is some delay in the process of acquisition of land then hike in prices and inflation be also kept in view while determining compensation.
