A single-member bench of the Islamabad High Court comprising Justice Tariq Mehmood Jahangiri Thursday dismissed the contempt of court petition filed by PTI President and former Punjab Chief Minister Chaudhry Parvez Elahi who has invoked the court jurisdiction claiming authorities committed contempt of court by rearresting him. Elahi has made Inspector General Police Islamabad, Deputy Commissioner, Senior Superintendent Police Operations, Station House Officer Shalimar police station and others as respondents in the matter.
At the outset of hearing on Thursday, the Bench inquired that was Elahi not released? On this, the lawyer said that Elahi was arrested near the police lines after being released.
On this, the court asked what is the difference between not releasing Elahi or arresting him again in another case. The court did not issue any order that he cannot be arrested in another case. It will be a contempt of court if Elahi was not released despite the court order, Justice Jahangiri observed.
Responding to the court query, counsel for Elahi submitted saying the Lahore High Court (LHC) had ordered not to arrest him in any case. On this the court said then the contempt of court petition would be filed before the LHC.
The court ordered that he should be released if he is not wanted in any other case, if he has been arrested in any other case, then the matter has to be looked into by the concerned trial court.
Justice Tariq Mehmood Jahangiri said while addressing the Elhai counsel that Elahi was sitting with you in the car, when he was released, how was our order violated? Responding to the court observation the defense counsel submitted saying his client was re-arrested to frustrate the court order. However, the Bench dismissed the contempt plea observing the concerned court has granted remand of Elahi.
