ISLAMABAD
Petition seeking formation of Judicial Commission (JC) to probe into PIMS tragedy has been filed in Islamabad High Court (IHC).
Advocate Qasim Iqbal Jalali has filed petition in personal capacity seeking formation of JC comprising IHC judge .
It was requested in the petition that JC be constituted comprising judge of IHC or sessions judge West.
The petitioner took the plea that a tragic incident took place in PIMS on August 26.
The court has also been requested to order for conducting forensic for investigation into August 26 incident and conducting complete audit of fire alarm system of PIMS.
Federation, interior secretary, health secretary, chief commissioner and IG Islamabad have been made respondents in the petition.
The petitioner has expressed non-confidence on Fact Finding Committee constituted by government and has taken the plea the officers nominated in government committee cannot become part of committee due to clash of interest. It is basic norm of justice and a legal principle that no one can become investigation officer and judge in one’s own matter.
It has been said in the petition people have expressed no confidence on government committee at large scale. Director General Emergency can himself be among the responsible persons. Therefore, his presence in the committee is clear clash of interests.
