Islamabad High Court (IHC) has sought assistance over maintainability of law ministry application against providing information about Supreme Court (SC) employees to a citizen.
The petition filed by law ministry against provision of SC employees related information to a citizen came up for hearing before single bench of IHC led by Chief Justice (CJ) Athar Minallah Monday.
Additional Attorney General (AAG) Qasim Wadood appeared in the court on behalf of the federation.
The court remarked during the hearing of the case “you are federation . How have you come against the order for making public the information about the employees of the SC.
AAG told the court this is issue of fundamental rights.
The court remarked institutions have no fundamental rights.
The CJ IHC inquired “ should this court give notice to you on your application.
AAG told the court notice be issued to Pakistan Information Commission first. We bring it into your notice first. Let them satisfy about the maintainability of the application.
The petitioner took the plea that Pakistan Information Commission (PIC) ordered registrar SC to provide information to the citizen.
It was prayed in the application that the PIC decision for providing information is illegal therefore, it should be declared null and void. Order be issued to stop the implementation of PIC decision till the decision of the application.
The hearing of the case was adjourned for indefinite period.
