PESHAWAR
Peshawar High Court (PHC) has reserved judgment following completion of arguments in election commission assets case against former Chief Minister (CM) KP Ali Amin Gandapur.
A two members bench of PHC led by justice Arshid Ali took up the case for hearing Thursday.
Special secretary election commission and lawyers of petitioner appeared in the court.
The court inquired from counsel of Ali Amin Gandapur has he powers of jurisdiction to send notice. Have you given reply to election commission with reference to assets.
The court has powers to initiate proceedings within 120 days of collecting the assets.
The counsel for election commission said election commission has powers to initiate proceedings at any time in criminal cases.
Justice Arshid Ali remarked election commission has prescribed time for disqualification in assets case.
Counsel for election commission said it is not disqualification. Election commission holds inquiry on its own before it. Chief minister has obtained stay order since 2024 under 62(1)F application.
He said elected representative files reply in regard to his assets by the end of every financial year. According to law we have powers to seek annual assets from elected representative.
The court reserved judgment on completion of arguments.
