ISLAMABAD : Justice Mohsin Akhtar Kayani of Islamabad High Court (IHC) has remarked only police is entitled to make arrests as per law but the other institutions are also making arrests.
He gave these remarks during hearing of petition seeking recovery of a missing citizen Abdul Quddus here Monday.
The court wrapped up the petition with necessary directives following the recovery of the citizen Abdul Quddus as he returned to his home before summoning of interior minister.
Interior secretary appeared before the court in missing persons case.
Additional Attorney General (AAG) told the court missing citizen Abdul Quddus has reached his home.
Justice Mohsin Akhtar Kayani remarked the motive behind summoning interior minister and interior secretary was to inform them about rising cases of missing persons. According to police the number of missing persons in Islamabad has surpassed 50. The powers to arrest rests with the police only as per law. But here the other institutions are arresting the people too.
AAG told the court Prime Minister (PM) and federal cabinet have already taken notice of missing persons related incidents.
Justice Mohsin Akhtar Kayani remarked “ inform the PM and federal cabinet about overall situation. If this is the situation in Islamabad then what will be happening IN other parts of the country. The courts cannot on their own get recover the people by going therein. The orders have to be issued to the police. The powers for arresting the people lie with the police only as per law. It is deplorable that other institutions are making arrests too which runs contrary to the law.
He observed safeguarding the fundamental rights of the people is the responsibility of federal government. This will be misconduct on the part of federal government if any institution hampers the process of protection of rights.
