PTI has filed petition in Peshawar High Court (PHC) against postponement of KP Assembly polls.
The petition has been filed by PTI leader and speaker KP assembly Mushtaq Ghani.
The petitioner has taken plea in the petition that governor KP has given the date of October 8 for polls. Governor KP Haji Ghulam Ali made the announcement on May 28 but Election Commission (EC) did not notify it.
It has been further said in the petition that holding polls within 90 days from the date of dissolution of assembly is must. The date of April 8 given by the governor KP is illegal and unconstitutional.
The petitioner has requested the court if the elections can not be held within 90 days then these should be conducted within least time. Governor KP should be ordered to give date for holding polls immediately.
EC, Federal and provincial governments, KP governor and president of Pakistan have been made respondents.
Talking to media men outside PHC , Speaker KP assembly Mushtaq Ghani said we dissolved our two assemblies. We want election. An incompetent government is in power at present. Government is postponing the election by making excuses.
He said we are initiating legal proceedings on every forum. We are thankful to Supreme Court (SC) about its decision regarding polls in Punjab. SC gave decision that we should again file petition. Today we have filed petition. Mushtaq Ghani further said the incumbent government enjoys no constitutional position. The mandate of care taker government is to hold election only. All the parties have set their quota in the government.
Speaker KP assembly said we supported care taker chief minister. Today the ink of his pen comes from governor house. Caretaker chief minister KP is helpless. Chief minister should not spoil his credibility and step down. We are going to file reference against him. He further said chairman PTI Imran Khan will decide to participate in All Parties Conference (APC).
