Registrar has no authority to return petitions declaring them non-maintainable: FCC

ISLAMABAD: Federal Constitutional Court (FCC) has remarked registrar is not entitled to return the petitions declaring them non maintainable and only court can determine maintainability of the petition or otherwise. According to media reports, Justice Hassan Azhar Rizvi issued 6-page decision regarding chamber appeal against registrar’s objections. It has been said in the written decision that registrar job is only of administrative nature. Registrar office can raise objections of administrative nature only. Registrar office can return the petition only if it has been filed against the rules. Registrar office cannot exercise court’s powers in any way. FCC observed there is no such room in the constitution that judicial powers be assigned to any administrative officer. Assigning judicial powers to administrative officer is against the distribution of powers laid down in the constitution. Registrar office cannot declare any petition non-serious too. It is pertinent to mention here registrar office had returned constitutional petition of Razia Bibi on February 14 by raising the objection of being non- maintainable. The petitioner had filed chamber appeal against registrar office decision. ONLINE
