SC nullifies EC decision for registration of case against PTI MPA for holding fake degree

ISLAMABAD, Feb 03 (Online): Supreme Court (SC) has nullified the Election Commission (EC) decision in connection with registration of case against Faisal Zaman, PTI member of provincial assembly for holding fake degree.

The court has admitted appeal plea by Faisal Zaman for hearing against the EC decision.

A 3-member bench of SC presided over by Justice Umar Ata Bandial took up the case for hearing Wednesday.

Counsel for Faisal Zaman took the plea during the hearing of the case that university has verified the degree of his client. This case does not fall in the jurisdiction of EC.

Justice Umar Ata Bandial remarked that only court can give the decision about disqualification as per constitution. HEC is not a court that it could disqualify any one on the basis of fake degree. HEC recommendations cannot be maintained.

The court maintained the EC did not record evidence. The court can give such decision after recording the evidence.
EC had given decision for registration of case against Faisal Zaman in 2013 for holding fake degree.

The court has admitted for hearing appeal plea filed by Faisal Zaman against EC decision. .
