SC wraps up Petition filed against ban on free movement of late Dr Abdul Qadeer khan being infructuous

Supreme Court (SC) has wrapped up petition against ban on the free movement of late nuclear scientist Dr Abdul Qadeer Khan declaring it infructuous.

A 3-member bench of SC presided over by Chief Justice of Pakistan (CJP) Umar Ata Bandial took up the case for hearing Thursday.

Counsel for Dr Abdul Qadeer Khan took the plea government prevented Dr Abdul Qadir Khan from making free movement in defiance of article 15 of the constitution. Dr Abdul Qadeer Khan was kept under detention after 2005 in the name of security. His daughter wanted to appear in the court. She could not appear in the court due to ill-health of wife of Dr Abdul Qadeer Khan. The state has not attributed any building or road to the name of Dr Abdul Qadeer Khan so far.

The Chief Justice of Pakistan (CJP) Umar Ata Bandial remarked Dr Abdul Qadeer Khan had fallen ill and he remained under treatment in ICU. Family of Dr Abdul Qadeer Khan was allowed to meet him. He was hero of Pakistan. Family of Dr Abdul Qadeer Khan will talk about what in this case. SC has paid rich tributes to Dr Abdul Qadeer Khan for the services rendered by him for the country in its orders.

If you want to get issue any directive to government with reference to this case then file new petition in respective court. This petition of Dr Abdul Qadeer Khan has become infructuous.

Sheikh Ahsan ud Din counsel for Dr Abdul Qadeer Khan said while talking to media men later Dr Abdul Qadeer Khan was benefactor of Pakistan who had to endure jail terms for long period. Ban was imposed on his movement. He was prevented from meeting his family members and others. This case does not become infructuous. The court has not become agreed with our plea.
