State land is trust of people with the institutions: SC

ISLAMABAD, Nov 17 (Online): Supreme Court (SC) has summoned report from senior member board of Revenue and secretary board of revenue in the case pertaining to encroachments in Bani Gala and demarcation of botanical garden.

A 3-mmeber bench of SC presided over by Justice Omar Atta Bandial took up the case for hearing Tuesday.

Additional Attorney General (AAG) told the court during the hearing of the case survey of Pakistan could not get all the record about botanical garden. ICT gave some record to survey of Pakistan. But Punjab government did not provide record.

AAG prayed the court to constitute a high powered committee on the matter so that all the authorities could settle the matter by sitting at one venue .

Advocate General (AG) Islamabad took the plea survey of Pakistan presented two maps of the said area in the past. According to 2004 map botanical garden comprises 725 acres land. The real issue is forest and land of rakh. Forest land is owned by government of Punjab and record is also held by it. ICT was constituted in 1981.

Representative of forest department Punjab told the court “ we had leased out 721 acres to CDA.

Justice Umar Ata Bandial remarked “ all the area of botanical garden is not disputed. This can be settled easily which area is disputed. This is precious state land and it is trust of people with the institutions. Its boundaries be fixed.

The court while summoning report from senior member board of revenue and secretary board of revenue adjourned the hearing of the case till second week of December.
