Supreme Court (SC) while rejecting PTI chairman petition filed against High Court (HC) order in connection with Toshakhana trial has remarked supervisory jurisdiction on trial courts is of high court only.
” we cannot interfere in proceedings of trial court at this time. Let Islamabad High Court (IHC) decide. Possibility is there high court gives order for stopping trial tomorrow, the SC further remarked.
The matter came up for hearing before a 3-member bench of SC presided over by Justice Yahya Afridi Wednesday.
During the hearing of the case Justice Yahya Afridi inquired the case is fixed for hearing in High Court on what date.
Khawaja Haris told the court the case is fixed for hearing tomorrow in high court.
Justice Yahya Afridi remarked what relief you had sought we had given. It is surprising that even then you resorted to SC.
Khawaja Haris took the plea the real question is of jurisdiction.
Justice Yahaya Afridi remarked your petition had become in-fructuous. Even then we heard it and gave order. We are understanding the situation. We had thought high court would give you better order. We had written in the order the high court should hear the petitions together. May be what relief you are demanding high court gives that decision.
Khawaja Haris told the court high court did not give stay. Therefore, we have come to SC.
The SC maintained let high court decide first. If you don’t get relief then the case is pending hearing in SC.
The court while rejecting Chairman PTI plea for immediate relief adjourned the hearing of the case till August 04.
The court also issued notices to the respondents.
