ISLAMABAD: Federal Constitutional Court (FCC) has sought legal assistance regarding powers of jurisdiction on suo motu proceedings which is underway in senior journalist Arshid Sharif murder case. The court while seeking progress report in investigation said it should be told the investigations had reached where. During the hearing of the case, Justice Aamir Farooq remarked it should also be made clear what steps can be taken constitutionally to bring those responsible for murder to dock. The court inquired does constitutional court wield powers to continue suo motu proceedings after 27th constitutional amendment. The court directed the lawyers of respondents to provide assistance on this legal point on next hearing. We have to see the powers of jurisdiction besides regulating the court’s proceedings because constitutional court can not run any case without hearing. The court also made it clear the purpose of the proceedings should be for what suo motu notice was taken. The counsel for wife of Arshid Sharif took the plea court’s precedents are there under which constitutional court can move ahead suo motu proceedings. The court while seeking latest progress report into investigation of murder case adjourned the hearing of the case till December 17. Online
