Court allows civil judge candidate to appear in psychological test

In a significant order protecting the rights of competitive exam candidates, the Peshawar High Court on Tuesday directed the Khyber Pakhtunkhwa Public Service Commission (KPPSC) to allow a candidate for the post of Civil Judge to appear in the upcoming psychological test and interview.
A division bench comprising Justice Ijaz Anwar and Justice Faheem Wali issued the directive while hearing a writ petition filed by Muhammad Abdullah, who had earlier been permitted by the court to sit in the written examination despite a shortfall of two months in the mandatory two-year legal practice experience. Advocate Nouman Muhib Kakakhel, appearing on behalf of the petitioner, argued that pursuant to the court’s earlier permission, the petitioner took the written examination for Civil Judges and successfully cleared it on merit. However, the KP Public Service Commission subsequently issued call letters for the next phase — the psychological test and interview — but excluded the petitioner without justification.
The learned counsel contended that the petitioner, having already been permitted to appear in and having passed the written examination, had acquired a vested right to be considered for the remaining stages of the recruitment process.
