Marriage of free will
ISLAMABAD: Federal Constitutional Court (FCC) has allowed the woman to go with her husband who has contracted marriage out of her free will. The court directed the parents of the girl to resort to respective forum in connection with fake Nikkah. The girl took the plea in the FCC she was not kidnapped and she contracted marriage out of her own free will. As per media reports the counsel for the parents took the plea girl is 12 years old. Nikkah of minor girl cannot be solemnized. Justice Hassan Rizvi said birth certificate and “Bay form” were taken late by ten years. Girl does not look like 12 years old in any way. The girl recorded her statement before magistrate under section 164. Girl is saying she has not been kidnapped. She is telling she is adult. Justice Hassan Rizvi said marriage had taken place 6 months before. The girl embraced Islam before marriage. The FCC wrapped up the case related to marriage out of free will . A two members bench of FCC presided over by Justice Hassan Rizvi heard the case. Online
