ISLAMABAD: Federal Constitutional Court (FCC) has withdrawn the Supreme Court (SC) 2018-2019 orders directing the demolition of Nasla tower. The FCC said the powers for launching action against illegal constructions basically are powers of provincial government and not of judiciary. Courts should remain limited to the conflict placed before them and should not make unnecessary interference. It has been said in the decision SC issued broader orders by going beyond the scope of pending hearing case. The orders for demolition cannot be given without meeting legal requirements on the basis of reports of Sindh Building Control Authority. The FCC wrote in its order effective legal system and respective institutions are already there to deal with illegal constructions in Karachi. Sindh government and respective institutions are legally and constitutionally bound to take action and monitor illegal constructions. The FCC withdrew SC December 21, 2018 and January 22, 2019 orders and action taken under these orders. Justice Syed Arshid Hussain Shah wrote an additional note. He said therein that protecting the basic rights of the citizens and public facilities is first and foremost obligation of the state. Parks, play grounds, green belts, foot paths and other public places be kept safe from possessions and changes. ONLINE
