Supreme Court (SC) has nullified Peshawar High Court (PHC) decision in connection with constitution of committee to determine the prices of live stock and poultry goods.
The court has maintained high courts have no powers to take suo motu action under article 199 of the constitution.
As per SC 8-page detailed decision written by Justice Ijaz ul Ahsan only the matter of prices of goods was pending hearing with high court. High court exercised powers for taking suo motu notice more than once . High court gave decision for imposition of ban on the export of poultry items. The powers for import and export of goods rest with administration and not with court. High court not only exercised powers for taking suo motu notice but also interfered in the administrative affairs .
The court remarked several flaws are there in high court decision regarding jurisdiction powers of court.
