ISLAMABAD : Chief Justice (CJ) Islamabad High Court (IHC) Athar Minallah has remarked how can the prisoners who have completed their jail sentence be kept in jail.
Indian prisoners release case came up for hearing before IHC bench led by CJ Athar Minallah Thursday.
Additional Attorney General (AAG) filed report in the court in Indian prisoners release case.
AAG Tariq Khokhar while presenting report in the court said Pakistan has sent back two more Indian prisoners to India who were involved in spying and terrorism cases. Security clearance and further proceedings is required under official secret act against one Indian prisoner.
CJ IHC inquired from AAG what has happened regarding Indian prisoners.
AAG told the court 5 prisoners were repatriated to India on October 26.
CJ IHC inquired tell the court about the remaining prisoners. 5 were earlier sent back. These prisoners were sentenced by Military courts and they completed their jail term. Under what law you can keep them in jail when their jail sentence has been completed. Satisfy the court legally that how can any prisoner be kept in jail on completion of jail sentence.
The court sought arguments on next hearing on the acquittal plea of an Indian prisoner.
The court on the request of AAG directed to club one Indian prisoner petition with Kulbhushan case.
The court while seeking arguments from Indian high commission and AAG on next hearing adjourned the hearing of the case till November 9.
