How can you curb his freedom when Lt Gen (Retd) Asad Durrani has been convicted: IHC

ISLAMABAD, November 20 (Online): Islamabad High Court (IHC) has directed defence ministry to file reply within 10 days with regard to petition seeking removal of name of former DG ISI Lt Gen (Retd) Asad Durrani from Exit Control List (ECL).

The case came up for hearing before IHC bench led by Justice Mohsin Akhtar Kayani Friday.

Justice Mohsin Akhtar Kayani remarked if defence ministry does not file reply then this case will be decided.

Justice Kayani while addressing Additional Attorney General (AAG) Tariq Khokhar remarked “ according to you Asad Durrani has been convicted after charges of misconduct were proved. When punishment has been awarded then how can you curb his freedom. You have abolished the pension and other perks already as punishment.

Tariq Khokhar told the court “ I will inform the court on next hearing after obtaining directives. There are some other issues too on this count.

Justice Kayani remarked “ there is nothing such like in the record so far. The situation would have been different had Lt Gen (Retd) Durrani been put in jail by you. This situation is also not there in this case. Question is this what you were to do you have done. You want to do what by keeping his name on ECL.

The court remarked “ After dragging the people in the court you will do what by seeking time. you have mentioned nothing what decision you have made. You have concealed the reasons so far. Defence ministry has told no reason for keeping his name in ECL.

The court while giving last chance of filing reply adjourned the hearing of the case till December 04.
