ISLAMABAD: Supreme Court (SC) has remarked husband can give dower out of joint property to the extent of his own share. The SC while deciding important legal point about transfer of property given in dower has maintained any share holder of joint property can not transfer property more than inherited share Justice Shakeel Ahmad of SC has issued written decision on the civil petition against the decision of Peshawar High Court (PHC) wherein the court dismissed the petition. It has been said in the decision husband can give dower out of joint property to the extent of his own share. While claim of giving the whole home in dower can not influence rights of other inheritors. The SC directed Nikkah registrar and Nikkah khawan to ensure confirmation of ownership of property mentioned in dower. The court has ordered to include a separate column about ownership of property in Nikkah nama to avoid legal proceedings. The court directed to send copies of the decision to all provincial chief secretaries for implementation. DNA
