Justice Ijaz ul Hasan has remarked if the people are lifted through state machinery then it will be a criminal offence.
He further remarked the contempt of court will take place when this crime is committed. We can not presume any crime. No complaint has come against Ata Tarar and Rahila to us. The petitioner should prove the allegation of contempt of court he has leveled so that we could come to know that the court order has been violated or otherwise.
He observed we are sitting here. Our eyes are not closed. Our eyes are on our order too and on law. We will keep our eye on the violation of law.
Justice Ijaz ul Hasan gave these remarks while presiding over two members bench of Supreme Court (SC) during the course of hearing of contempt of court case against interior minister Rana Sana Ullah here Thursday.
Faisal Chaudhry counsel for PTI gave arguments over the transcript of Rana Sana Ullah statement that Rana Sana Ullah gave statement of moving our men hither and thither . Our MPA Masood Majid was purchased in the sum of Rs 400 million and was smuggled to Turkey. PML-N lady Rahila contacted our three MPAs. Atta Tarar offered Rs 250 million to our 3 MPAs.
Justice Munib Akhtar raised question on this occasion Rahila talked to your MPAs on what date. Where is original affidavit. The narration made on all the three affidavits is same.
Faisal Chaudhry while requesting the court to take suo motu notice against Ata Tarar and Rahila told that election commission has not issued notification of successful MPAs. Our relations with election commission are tense.
Justice Munib Akhtar remarked taking suo motu notice is powers of Chief Justice of Pakistan.
Justice Ijaz ul Hassan while addressing Faisal Chaudhry remarked your relations with Election commission will be tense but not with us. Still two days are there. If such thing happens then we will see it. The court order is there. Notification of successful MPAs should be issued before election of chief minister.
The court while ordering PTI to bring more evidence on court record regarding contempt of court adjourned the hearing of contempt of court petition for indefinite period.
