IHC restrains NHA from collecting additional toll charges

ISLAMABAD: Islamabad High Court (IHC) has restrained National Highway Authority (NHA) from collecting additional toll tax from the citizens. Stopping NHA from collecting additional toll tax from citizens, Justice Arbab Muhammad Tahir of IHC has suspended till next hearing notification of charging 50 percent additional toll tax to Non M-TAG motorists and with low and insufficient balance in their M-tag. Muhammad Jalal Haider counsel for the petitioner appeared in the court during the hearing of the case and took the plea NHA issued a notification on May 30, 2025 that NHA has imposed extra 50 percent toll on vehicles without M-Tag use and insufficient M-Tag balance. Under section 10 of NHA law only toll tax can be collected. No mention is made about imposing penalty on non M-Tag vehicles and insufficient M-Tag balance in NHA rules. The petition said that NHA May 30, 2025 notification be nullified by declaring it unconstitutional. The fine recovered from the people in the perspective of May 30, 2025 notification be returned to them. The court while issuing notice to ministry of communication, NHA and other respondents for submitting reply has adjourned hearing till August 3. ONLINE
