ISLAMABAD: Islamabad High Court (IHC) has suspended Election Commission (EC) order regarding recounting in constituency BP-21 Balochistan. The court issued stay order on the petition of candidate Muhammad Saleh Bhutani. The court while issuing notice to the respondents sought reply within two weeks. IHC ordered to fix the case for again hearing after Eid ul Fitr. As per orders the petitioner had requested for declaring Election Commission February 25, 2026 order illegal. The petitioner requested the court to issue order to EC for maintaining the election result as per form 47. The petitioner requested the court to order Returning Officer (RO) to prepare form 48 and 49 on the basis of form 47. According to counsel EC order is sheer violation of section 95 (6) of election act-2017. According to petitioner the order for recounting was given on the basis of presumptions. No solid material was there. According to counsel of the petitioner EC gave the order for recounting without giving notice to the respondents. EC decision is violation of article 10-A and decisions of Supreme Court. Online
