Former chairman PTI Imran Khan has challenged Cipher case in High Court
It has been requested to Court to declare the proceedings of Cipher case so far as illegal besides acquitting Imran Khan by nullifying the proceedings. The proceedings carried out from November 23 uptill now by trial court is Illegal and against the ingredients of justice. On December 12 trial court rejected our petition in cipher case. Judge of Trial court did not interpret correctly of the word complaint in section 13 (2) (3) of official secret Act.
It was further said in the petition the interpretation of the word complaint is very clear in the law.
No mention has been made about report of police officer. The word complaint was made clear in section 4 (h) of criminal procedure. According to law, the complaint means verbal and written request before the magistrate in connection with any allegation.
The pending hearing Cipher case is being run against Former Chairman PTI on the basis of FIR and police report. Official secret Act is penal law which is different from common law. It is imperative to persuade legal process while applying official secret Act being the panel law.
